Beta Service Agreement

Welcome to BoardroomABA ("we," "us," or "our"). By accessing or using our beta service, you agree to be bound by these Terms of Service.

Important: BoardroomABA is currently in beta. The service may contain bugs, experience downtime, or undergo significant changes. Use at your own discretion.

Acceptance of Terms

By creating an account or using BoardroomABA, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you may not use the service.

Beta Service Disclaimer

BoardroomABA is provided "as is" and "as available" during the beta period. We make no warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of AI-generated feedback

The AI examiner feedback is simulated and may not reflect actual exam performance or outcomes.

Use of Service

Eligibility

You must be at least 18 years old to use BoardroomABA. By using the service, you represent that you meet this requirement.

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate information when creating your account
• Notifying us immediately of any unauthorized use

Prohibited Uses

You agree not to:

• Use the service for any illegal purpose
• Attempt to gain unauthorized access to the service or other accounts
• Interfere with or disrupt the service or servers
• Use automated systems to access the service (scraping, bots, etc.)
• Share your account with others
• Attempt to reverse engineer or extract proprietary algorithms
• Use the service to create competing products

Service Limitations

During the beta period:

• Service availability is not guaranteed
• We may limit usage (currently 5 sessions per day per user)
• Features may change or be removed without notice
• Data may be reset or lost during beta
• We reserve the right to terminate beta access at any time

Intellectual Property

The BoardroomABA service, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your user-generated content (session transcripts, etc.), but grant us a license to use, store, and process this content to provide the service.

You may not copy, modify, distribute, sell, or lease any part of the service without our written permission.

Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the service (currently $0 during beta)
• We are not responsible for any decisions made based on AI-generated feedback
• We do not guarantee exam outcomes or certification success

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these terms.

Termination

We may terminate or suspend your access to the service immediately, without prior notice, for any reason, including:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• End of beta period

You may terminate your account at any time by contacting us or deleting your account through the service.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.
